These terms and conditions relate solely to purchases made via our web shop, for purchases made during in home presentations or on our premises please see the terms and conditions set out in your sales contract.

We operate the website https://www.comfomatic.com/shop (the ‘site’), as well as any other related products and services that refer to these legal terms (‘legal terms’) collectively the (‘services’)

These legal terms constitute a legally binding agreement between you, whether personally or on behalf of an entity (‘you’), and COMFOMATIC LIMITED, concerning your access to and use of the services. You agree that by accessing the services, you have read, understood, and agreed to be bound by all these legal terms. IF YOU DO NOT AGREE WITH ALL THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

The services are intended for users who are at least 18 years old, persons under the age of 18 are not permitted to use or register for the services.

  • 1. OUR SERVICES
    Our site is intended for use by people resident in mainland Great Britain and Northern Ireland. We do not accept orders where delivery is required to locations outside mainland Great Britain and Northern Ireland, more information on our delivery locations please contact us on 0151 559 1140.
  • 2. YOUR STATUS
    By placing an order on our site, you warrant that:

    • you are legally capable of entering into binding contracts.
    • you are at least 18 years old.
    • you are resident in and require delivery to one of the locations set out in our delivery section and.
    • you are accessing our site from within mainland Great Britain and Northern Ireland

    You agree to provide current, complete, and accurate purchase and account information for all purchases made via the website. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. We may change prices at any time. All payments shall be in GBP.

    After placing an order online and clicking “complete order”, we will take payment for your order; you will then receive an email from us acknowledging that we have safely received and accepted your order. The contract between us (our Contract) will only be made when we send you the email confirming acceptance of your order.

  • 4. DELIVERY
    We aim to despatch all orders within 5 days of acceptance of the order but give no guarantee of delivery within this period. If you are in a remote area, delivery may take a little longer.
  • 5. RETURNS
    We hope you are happy with your purchase from our store however, in addition to your statutory rights, if you have changed your mind, you can return your product within 14 days. Product must be unused, in its original packaging and accompanied by a valid proof of purchase. We will offer a full refund on the bases that this policy is followed. If there is any issue, please feel free to give us a call on 0151 559 1140. This policy does not affect your statutory rights.
  • 6. YOUR INFORMATION
    We process information about you in accordance with our privacy policy. By using our site, you consent to such processing. By making a purchase form us, and agreeing to marketing, you agree that we may contact you including by telephone to keep you informed about special offers, our products, and services. You can withdraw this permission at any time simply by contacting us.

    We only supply the Products for domestic and private use. You agree not to use the Products for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

    If we fail to comply with these Terms and Conditions, we are responsible to you for the loss or damage you suffer that is a foreseeable result of our breach of these Terms and Conditions. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered the Contract. Your remedies will be limited to damages and under no circumstances will our liability exceed the price of the Products you purchased.

  • 8. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
    From time to time, we have the right to revise and amend these Terms and Conditions. You will be subject to the Terms and Conditions in force at the time that you order Products from us therefore we recommend that you check these Terms and Conditions each time you order any Products.

    You will be subject to the policies and Terms and Conditions in force at the time that you order Products from us, unless any change to those policies or these Terms and Conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these Terms and Conditions before we send you the order confirmation, in which case we have the right to assume that you have accepted the change to the Terms and Conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products.
    We reserve the right to correct any error or omission in any information, or document issued by us.

  • 9. YOUR STATUTORY RIGHTS
    You have a right to cancel any purchase made via this website without giving any reason. The cancellation period will expire 14 days from the day after the goods are received to you. To exercise the right of cancellation you must inform us in your decision to cancel this purchase via a clear statement (e.g., a letter, an email or via the telephone). If you cancel this contract, we will cover the cost of returning the product to us, we will refund all payments received from you. Any refund will be made to the card used to make the purchase. The right of cancellation is provided so that you have a reasonable opportunity to inspect the goods, you should not use the goods during this period. If you use the goods or if the goods are devalued by excessive handling by you, we will make a deduction from the refund, for loss in value. We will make any refund due without any undue delay and not later than 14 days after we receive the goods back from you.

    For hygienic reasons bedding is supplied within sealed packaging, you will lose the right of cancellation or have no right of cancellation if you breach or remove the hygiene packaging following delivery.
